Professor Robert Garda Discusses Supreme Court Disability Case on Bloomberg Radio

Professor Robert Garda detailed the facts of Endrew F. v. Douglas County School District for listeners of Bloomberg Radio’s “Bloomberg Law” program on January 11th.  The case involves a Colorado couple who claim their autistic son was not provided an adequate education in the public school system as required by federal law.  Following poor performance in public schools, the parents placed their child in a private school.  The parents sought reimbursement for tuition and related expenses under the Individuals with Disabilities Education Act (IDEA), which permits court-ordered reimbursement if a district violates the requirement for a "free appropriate public education" (FAPE) under the IDEA.  Lower courts rejected so far have rejected the parent’s claim, saying the public schools did provide “some educational benefit.”
